Wine-Specific Conditions
Legal Requirements
You must be 21 years of age or older, to order or receive alcoholic beverages from Fortuity Cellars. By placing your order you certify under penalty of perjury that you and the recipient are at least 21 years old. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). The willful misrepresentation of your age or the age of the recipient is a crime in most states. Wines purchased from Fortuity Cellars are not for resale and are for personal consumption only.
Credit Card Charges
Orders are by credit card only. We accept Visa, MasterCard, American Express and Discover.
Wine Club Agreement
Wine club members must be 21 years of age or older. Club membership requires a one-year commitment (minimum of two seasonal wine club selections, after your initial purchase). Credit card on file will be run twice a year for regular wine club shipments and any other purchases approved by the member. All wine club orders are final and non-refundable; even exchanges may only be made at the discretion of management and for those in customizable in club levels.
Club membership holds or cancellations must be sent by the account holder by email (info@fortuitycellars.com or emily@fortuitycellars.com) and received at least 14 days prior to the next wine club release/processing. If cancelling membership within 14 days or prior to receiving your full year of shipments (two releases + initial purchase), a $75 cancellation fee may be charged to the primary card on file. Members are allowed to pause membership once their initial commitment of one year is fulfilled. Paused memberships last for one release cycle and then the membership becomes active again.
Those club members opting for pickup, wine shipments must be picked up within three months or wines are shipped directly to the member at the member’s expense (non-Yakima and Kittitas County addresses only) or donated to a nonprofit. We will make every attempt to notify the club members by email in advance of the three-month mark that wines are to be picked up or shipped soon. Club members with Yakima and Kittitas County addresses are required to pick up at the Yakima Valley winery or Ellensburg location. If the credit card on file is not valid, and we can't charge for shipping, your wine club shipment may be forfeited and donated to a local nonprofit.
If the shipping address is not valid (or returned to us), wine club shipment will be forfeited. If credit card is not valid, we will attempt to contact club member to update, but after several failed attemps, wine club shipment will be forfeited and club membership may be cancelled.
Wines that are shipped require a signature of a person who is 21 years of age or older. We strongly recommend that you ship to a business address. Wine shipments may not be left on a door step. We are not held responsible for misdirected or returned shipments.
Members are responsible for keeping their online account updated with any changes to credit cards, billing and shipping addresses, email and phone number. We reserve the right to hold shipments due to extreme weather.

Minimum Purchase for Shipping
Three bottle minimum purchase is highly encouraged for shipments at this time.
Refurn Policy
We do not refund any alcohol purchases made at the winery, tasting room or on the website.
States Authorized for Direct Shipment
Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to all states except those which are not listed when you check out.
Shipping Costs
Federal Express Ground (WA, ID, OR, DC, MN and FL) is Fortuity Cellars carriers of choice (common carrier). Ground shipping is provided by Federal Express Ground at current market rates. *Note – If the customer selects Fed Ex Air as his or her carrier, the customer pays all shipping charges, regardless of his or her wine club membership or purchase amount. Our third party shipper may use Federal Express Ground or UPS.
Wine is a Delicate Commodity
Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Fortuity Cellars will hold all wine shipments until it feels like it is safe to ship. Fortuity is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
